General Terms and Conditions (GTC)
Please read the following information carefully.
Validity
The General Terms and Conditions ("GTC") of Guttentag Solutions GmbH (hereinafter "Guttentag Solutions") are an integral part of the contract concluded between the client and Guttentag Solutions for the provision of analytical services. The client is the natural or legal person who orders an analytical service from Guttentag Solutions. These GTC also apply to purchase contracts concluded via the website www.cbd-test.ch. By visiting and using our website, by placing an order on our website, and/or by confirmation via e-mail, post or telephone, you expressly declare that you have read and accept these GTC and the Privacy Policy. Company details can be found in the legal notice at www.cbd-test.ch/impressum.
Amendments and additions to these GTC must be in writing. Guttentag Solutions reserves the right to amend the GTC at any time. The current version is available at www.cbd-test.ch/agb. For each order, the GTC valid and confirmed by the client at the time of the order shall apply.
Prices
All prices are quoted in Swiss francs (CHF) including VAT. Guttentag Solutions reserves the right to change prices at any time. The prices stated on the invoice are authoritative. If these prices exceed those at the time of the order, the latter shall apply. Price changes and errors are reserved. Any specific information the client requires on the invoice must be clearly communicated at the time of placing the order. All services provided by Guttentag Solutions are performed exclusively in accordance with the valid price list or on the basis of a written quotation and these GTC, unless the latter have been modified by written agreements. Deviating order or purchase conditions of the client that have not been expressly acknowledged in writing are not binding; they may be expressly objected to.
Orders and right of cancellation
The order is confirmed by Guttentag Solutions by means of an automatic acknowledgement of receipt. This automatically sent e-mail serves solely to inform you of the successful data transmission. It does not constitute a binding contract and does not yet constitute acceptance of your order. Acceptance (conclusion of contract) only takes place upon receipt of the samples by Guttentag Solutions.
Orders may be cancelled free of charge up to the time of receipt of the samples by Guttentag Solutions. In this case, payments already made will be refunded within 14 days via the same payment method or, at the client's request, credited to the client account.
Upon receipt of the samples by Guttentag Solutions, the analysis commences immediately. From this point on, cancellation is no longer possible. The service will be invoiced in full.
User account and password
In order to access certain functions of our website and/or to place an order, clients are asked to register and create an account. By creating the account, the client agrees to our Privacy Policy.
Clients are responsible for the security and reliability of the password and other login credentials of the account. Clients assume full responsibility for all activities on their account. We are not liable for losses or damages arising from the improper handling of login credentials.
Clients are responsible for the accuracy and completeness of the personal data provided to us and guarantee that this data is complete and correct in all respects. Clients are obliged to inform us of any changes to this data or to access and update the data via their account.
Delivery times
The delivery period for services begins upon receipt of the samples and is dependent on the respective offer. The time frames are to be understood as indicative values and are not binding delivery deadlines. Our quality philosophy commits us to meeting deadlines. However, in the event of unforeseeable difficulties, we cannot make binding assurances. Force majeure, accidents, fire, staff absences or serious defects in testing equipment shall temporarily or permanently release Guttentag Solutions from its obligation to perform. The client will be informed immediately of any schedule changes.

The rates listed in our price lists are in Swiss francs and apply to individual samples. Discounts may be available by arrangement for larger order volumes. For express orders, the additional cost is added to the analysis price. Our rates are based on the respective wage and ancillary costs and may therefore be adjusted to price developments at any time. Monthly invoicing may be arranged for ongoing orders.
Payments by debit or credit card and via PostFinance e-Payment: All payment transactions may be subject to validity checks and authorisations, either by your bank or by us (whereby we may commission third parties to carry out this authorisation in accordance with our Privacy Policy). If the credit card provider does not make or approve the payment, we are not liable for delays or refusal to accept the order. Customer payments in the cbd-test.ch online shop are made in a secure area where data is transmitted in encrypted form. Guttentag Solutions implements appropriate technical and organisational measures to ensure the security of transmitted data. Liability for security deficiencies outside the sphere of influence of Guttentag Solutions is excluded.
Liability
Guttentag Solutions is liable exclusively for the careful execution of the commissioned analytical service. Liability is limited to the order value of the analysis in question. Any further liability is excluded to the extent permitted by law. Liability for intent and gross negligence is reserved.
Decisions made by the client on the basis of analysis results from Guttentag Solutions are solely the client's responsibility. This includes, but is not limited to: production decisions, further processing decisions, batch releases, sales decisions and regulatory decisions. The release of production batches is in all cases the responsibility of the producer. Guttentag Solutions assumes no liability whatsoever for direct, indirect or consequential damages, lost profits, loss of revenue, personal injury, official measures or consequential damages of any kind resulting from such decisions.
In the case of demonstrably incorrect analysis results, Guttentag Solutions will inform the client without delay. Correction is generally carried out by re-measurement and issuance of a corrected analysis report. There is no entitlement to a refund of the analysis price. Further claims arising from incorrect analysis results are excluded unless the error is due to gross negligence or intent.
Clients are responsible for ensuring the security of systems, programs and data within their sphere of influence. Clients should, in their own interest, keep passwords and usernames secret from third parties.
Guttentag Solutions is not liable for defects and disruptions for which it is not responsible, in particular not for security defects and operational failures of third-party companies with which it cooperates or on which it depends.
Samples
The responsibility for the delivery and condition of the samples lies solely with the client. Shipping costs are to be borne by the client. Guttentag Solutions assumes no liability for samples lost, damaged or confiscated by third parties or due to force majeure.
Samples never become the property of Guttentag Solutions. Retained samples generally belong to the client and may be reclaimed until the time of their disposal. Guttentag Solutions is at no time responsible or liable for the legal conformity of the samples. The client bears full responsibility in this regard.
Retained samples are stored for 2 weeks after completion of the order and then disposed of properly, unless otherwise agreed. The obligation for long-term storage of retained samples remains with the client.
If test specimens submitted to Guttentag Solutions pose special risks (e.g. explosive, carcinogenic, toxic), the client must communicate this by labelling the specimen containers and in writing when placing the order.
Quality assurance
Guttentag Solutions is ISO 9001 certified. The quality management system ensures the consistent quality of the analytical services.
The methods we use are generally validated by us. Official methods such as those of pharmacopoeias, food codices, and national and international methods are considered validated. If, in exceptional cases, we use a non-validated method, this is explicitly stated in the test report. Information on measurement uncertainty is available on request. Guttentag Solutions does not subcontract to external specialists or laboratories without informing the client.
Guttentag Solutions grants the client, subject to reservation, the right of access ("audit") to the premises where the analytical services are performed. Archived documents and raw data of the relevant test may be inspected upon request. Raw data can only be viewed on-site in the laboratory.
Archiving
Analysis results and the underlying raw data are archived for at least 5 years, unless otherwise agreed. Retained samples are stored for 2 weeks after completion of the order and then disposed of properly, unless otherwise agreed. Order forms for completed orders are archived for a maximum of 4 weeks. The obligation for long-term storage of retained samples remains with the client.
Reports
Issued reports are the property of the client and are available at any time from Guttentag Solutions or in the client account. The responsibility for the accuracy of the data presented lies with Guttentag Solutions. Defective reports are replaced free of charge (incorrect name, spelling errors, incorrect address; but not undesired results). Guttentag Solutions assumes responsibility for the accuracy of results only within the scope of validation and only for the sample provided.
The client is strictly prohibited from altering reports (e.g. changing results, covering the addressee) or extending them (watermarks, own logo). It is also strictly prohibited to falsify reports or parts thereof. Any unauthorised alteration of an analysis report is strictly prohibited and may result in civil and criminal consequences. Guttentag Solutions reserves the right to take legal action in the event of any violation.
The client agrees that their reports are accessible via QR code.
Confidentiality
Guttentag Solutions undertakes to treat information, analysis findings and procedures from the client's business area that are neither publicly accessible nor known as confidential. Unless otherwise agreed in writing, Guttentag Solutions shall communicate the results exclusively to the client. Excluded from confidentiality is the disclosure of documents and information in the context of official activities. Personal data is only passed on to third parties in the context of order processing and legal obligations. Details are governed by our Privacy Policy.
The QM system guarantees independence and impartiality towards clients and their processes.
Intellectual property
All analysis methods developed or applied by Guttentag Solutions are the intellectual property of Guttentag Solutions. This applies regardless of whether the development took place in the context of a client order or independently. Development costs are borne exclusively by Guttentag Solutions. The client does not acquire any rights to the analysis methods at any time.
The client is not entitled to apply Guttentag Solutions' analysis methods themselves, make them accessible to third parties or register protective rights thereon. The client undertakes to keep confidential all information regarding analysis methods that has become known to them in the course of cooperation. In the event of a breach, Guttentag Solutions is entitled to claim damages.
All raw data and chromatograms are the property of Guttentag Solutions. At no time is Guttentag Solutions obliged to hand over raw data or chromatograms to the client. Upon request, inspection may be granted subject to reservation and only on-site.
Copyright
All images used on the website cbd-test.ch are protected by copyright and may not be used without the written consent of the owners. cbd-test.ch as well as the analysis reports are registered and protected trademarks/designs of Guttentag Solutions. All rights reserved.
Termination
Individual orders are considered completed upon delivery of the analysis report and full payment. Post-contractual obligations (in particular archiving, confidentiality and intellectual property) remain unaffected.
The client may terminate their client account at any time in writing or by e-mail to info@cbd-test.ch. Any existing account balance will be refunded within 30 days via the payment method specified by the client. After deletion of the account, the associated personal data will be treated in accordance with the Privacy Policy.
Guttentag Solutions reserves the right to delete client accounts in the event of a violation of these GTC or inactivity of more than 24 months, following prior notice.
Severability clause
Should any provision of these GTC be or become invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a valid provision that comes as close as possible to the economic purpose of the invalid provision.
Dispute resolution
In the event of disputes, the parties shall endeavour to reach an amicable settlement before taking legal action.
Jurisdiction
Swiss law shall apply exclusively to orders concluded with Guttentag Solutions and these GTC. The place of jurisdiction for disputes arising from this contract is Dietikon, to the extent permitted by law. For consumers, the mandatory statutory places of jurisdiction pursuant to the Swiss Code of Civil Procedure (CPC) shall apply.
